Terms of Service

1. Acceptance of Terms

By using Sencé mobile application or sencetravel.com ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Sencé is operated by Malik Cingöz (bireysel geliştirici / individual developer, Türkiye). "Sencé", "we", "us" refers to this operator throughout these Terms.

2. Service Description

Sencé is an aggregator platform that allows users to search and book flights (Duffel), hotels (Hotelbeds), buses (FlixBus / Obilet), cars (Hotelbeds Cars), events (Ticketmaster), tours (Viator), and VIP transfers (Sencé partner drivers).

Important: Sencé acts as an intermediary. The actual service is provided by third-party suppliers. The contract for the underlying service is between you and the supplier (except VIP transfer, which is provided by Sencé partners).

We may suspend or terminate accounts for fraudulent activity, multiple chargebacks, violation of these Terms, or abusive behavior toward other users or staff.

4. Booking and Payment

4.1 Booking Process

  1. Search and select service
  2. Review pricing (taxes + fees included)
  3. Provide passenger/guest details
  4. Accept Mesafeli Satış Sözleşmesi (Turkey) or applicable terms
  5. Pay via Stripe (3D Secure)
  6. Receive confirmation via email + in-app

4.2 Pricing

All prices in TRY/EUR/USD as displayed, including Turkish VAT (18%) and applicable taxes. Subject to change before payment confirmation; once paid, locked in (no surge pricing).

4.3 Payment

Stripe processes all payments (PCI DSS Level 1). Apple Pay, Google Pay, credit/debit cards supported. 3D Secure / SCA mandatory for European cards (PSD2). Sencé never sees your card number.

4.4 Refunds

Subject to provider's cancellation policy. Refund processed to original payment method within 14 days.

5. User Content

You may post reviews of services, photos of trips, comments, and "pins" of places.

By posting content, you grant Sencé a non-exclusive, worldwide, royalty-free license to use, display, and promote your content within the Service.

You agree NOT to post illegal content, hate speech, spam, personal information of others (without consent), or copyrighted material (without permission). We may remove content violating these standards without notice; repeat violators may have accounts suspended.

6. Acceptable Use

You agree NOT to reverse engineer the app, use bots/scrapers, bypass security measures, resell bookings, impersonate others, or submit fraudulent payment info. Violations may result in account termination + legal action.

8. Third-Party Services

Service quality (flight delays, hotel issues, etc.) is responsibility of the provider, not Sencé. Each booking is subject to the provider's own terms. Sencé is not liable for disruptions caused by natural disasters, war, pandemic, government actions, carrier strikes, mechanical failures, or internet outages.

9. Limitation of Liability

To the maximum extent permitted by law:

  1. Sencé's total liability for any claim is limited to the amount paid by you for the affected booking.
  2. We are not liable for indirect, consequential, or punitive damages.
  3. We are not liable for loss of profits, data, or goodwill.

Exception: This limitation does NOT apply to death or personal injury caused by Sencé's negligence, fraud or willful misconduct, or mandatory consumer protections under Turkish, EU, or other applicable law.

10. Indemnification

You agree to indemnify Sencé against claims arising from your violation of these Terms, your user content, or your booking actions.

11. Privacy

Your data is processed under our Privacy Policy and KVKK Aydınlatma Metni.

12. Modifications

We may update these Terms. Material changes trigger email notification and in-app notification. Continued use after notice = acceptance. If you disagree with changes, delete your account.

13. Termination

You may delete your account at any time (Settings → Delete My Account). Sencé may terminate accounts for violation of these Terms, fraudulent activity, or long inactivity (24+ months, with email warning first). On termination, pending bookings are honored (refund per provider policy if cancelled), user content is removed from public view, and personal data is deleted (subject to legal retention).

14. Governing Law and Jurisdiction

Turkish users: Turkish law; İstanbul Mahkemeleri ve İcra Daireleri (or per Mesafeli Satış Sözleşmesi).

EU users: GDPR applies for data protection; consumer can sue in country of residence (per EU Consumer Rights Directive).

Other users: Turkish law, İstanbul jurisdiction, subject to mandatory consumer protections in your country.

15. Dispute Resolution

Contact fredcakmaktas@gmail.com first — most issues resolved in 7 days. Turkish consumers may apply to Tüketici Hakem Heyeti / Mahkemesi (TKHK Mad. 68). EU consumers can use the ODR platform (https://ec.europa.eu/consumers/odr).

16. Severability

If any provision is found invalid, the rest remains in effect.

17. Entire Agreement

These Terms + Mesafeli Satış Sözleşmesi (Turkey) + Privacy Policy + KVKK Aydınlatma Metni constitute the entire agreement.
